2. Research Use Only (RUO) Compliance and Eligibility

All Products are “FOR RESEARCH USE ONLY (RUO).” They are not intended for diagnostic, therapeutic, cosmetic, household, or any administration to humans or animals (in vivo or ex vivo).

By purchasing, the Buyer warrants to Peptide Tech that they will:

  • Use Products solely for research/laboratory purposes under appropriate supervision and SOPs.
  • Comply with all federal, state, and local rules for handling, storage, transport, and disposal (including OSHA and EPA/RCRA rules).
  • Not use Products in humans, animals, food, drugs, or cosmetics.
  • Not repurpose, formulate, compound, encapsulate, or prepare dosage forms.
  • Provide end-use attestations, KYC details, or institutional affiliations upon request. Orders may be refused for compliance or eligibility reasons.

3. Shipping, Title, and Risk of Loss

3.1 Carriers & Territory

We ship using UPS or FedEx to verifiable U.S. street addresses only. We do not ship to P.O. Boxes, APO/FPO, freight forwarders, virtual mailboxes, or third-party reshippers. Shipments to prohibited addresses will void all remedies.

3.2 Title & Risk Transfer (FOB Origin)

Title and risk of loss transfer to the Buyer when the sealed parcel is tendered to the carrier (FOB origin). This means that after the package is scanned by the carrier, the risk of loss, damage, or theft is yours, unless Route Shipping Protection is purchased (see Section 4).

3.3 Delivery Conditions

  • Address Accuracy: The Buyer is solely responsible for providing a complete, deliverable address. Orders returned as undeliverable may be refunded minus outbound/return shipping and fees or reshipped at Buyer’s expense.
  • Cold-Chain Items: Buyer must promptly retrieve and store temperature-sensitive Products upon delivery or carrier hold. Failure to do so voids leakage/temperature claims unless Route Protection was purchased and approved.

4. Route Shipping Protection (Loss, Damage, Theft)

This section outlines how shipping risk is allocated.

4.1 Mandatory Claim Path (If Purchased)

If you purchase Route Shipping Protection at checkout, all claims for loss, damage, theft, or non-delivery must be submitted directly to Route via their Resolve Center: https://claims.route.com/. Peptide Tech cannot process or decide those claims.

4.2 Allocation of Shipping Risk (If NOT Purchased)

Unless Route Shipping Protection is selected at checkout, Peptide Tech is NOT responsible for any loss, damage, theft, misdelivery, non-delivery, or carrier delay after tender to the carrier. To the fullest extent permitted by law, this risk is the Buyer’s responsibility, and we will not issue a replacement or refund for these carrier-related issues.

5. Returns & Exchanges — 180 Days

5.1 Eligibility and Condition

  • Non-Defective Returns (Buyer’s Remorse): Must be unopened, unused, and in original, intact tamper-evident packaging with all labels/lot numbers readable.
  • Defective Items: Accepted if the item is compromised upon arrival (e.g., broken seal, leakage, unexpected gelling/precipitation).
  • Not Eligible: Opened/used items, contaminated items, or items with removed/defaced lot labels or stored contrary to SDS.

5.2 Return Process

  1. Start Request: Email us at cs@peptide-tech.com to obtain a Return Merchandise Authorization (RMA) and our prepaid label. Do not ship anything back until authorized.
  2. Timing: Initiate the return within the 180-day Return Window and ship within 14 days of RMA issuance.
  3. Hazmat/Temperature-Controlled: We will provide compliant packaging/instructions or arrange a no-cost disposal process if a safe physical return is impracticable.

5.3 Refund Scope and Timing

We refund the Product price and standard outbound shipping (if charged) to the original payment method. Expedited shipping is non-refundable. Refunds typically post 5–10 business days after the return scan or verification.

5.4 Fraud Prevention (Anti-Abuse Guardrails)

  • Free returns are limited to the first two (2) units per SKU per Buyer in any rolling 365-day period unless approved.
  • Any suspected fraud or abuse—including using any portion of a Product and then attempting a return—immediately voids all current and future return rights from Peptide Tech and may be reported to payment processors and law enforcement. We may deny or limit returns where patterns indicate abuse.

6. Merchant Protections and Chargeback Remedies

6.1 Contractual Promise

By placing an order, Buyer agrees not to initiate a chargeback or payment dispute for any carrier-related issue (loss, damage, stolen, delay) if Route Shipping Protection was not purchased. Filing such a chargeback constitutes a material breach of contract.

6.2 Consequences of Breach

If a prohibited chargeback is filed, Peptide Tech may pursue all civil remedies, including for breach of contract and fraud, and recover:

  • All reasonable collection costs, chargeback fees, and attorneys’ fees.
  • Interest at 1.5% per month (or the maximum lawful rate).
  • Peptide Tech may file suit in the Buyer’s local county/city/parish/district to enforce payment obligations.

7. Warranties, Liability, and Indemnification

7.1 Warranty Disclaimer

Products are provided “AS IS” with all faults. Peptide Tech disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Limitation of Liability

Peptide Tech will not be liable for any indirect, special, incidental, exemplary, punitive, or consequential damages (including lost profits or lost data). In all events, our total aggregate liability shall not exceed the price actually paid for the specific Product(s) at issue.

7.3 Indemnification

Buyer shall defend, indemnify, and hold harmless Peptide Tech from any and all claims, losses, liabilities, fines, damages, and costs arising out of: (a) Buyer’s breach of this Policy or Law, (b) Buyer’s misuse, diversion, or unlawful end-use, or (c) third-party claims related to Buyer’s research activities.

8. Governing Law, Venue, and Limitations

  • Governing Law & Venue: This Policy is governed by Wyoming law, and the exclusive venue for disputes is the state or federal courts in Wyoming.
  • Waivers: Buyer waives any right to a jury trial and the right to bring or participate in a class action or representative proceeding.
  • Limitations Period: Any claim arising out of a transaction with Peptide Tech must be filed within one (1) year of delivery, or it is forever barred.

9. Acknowledgement and Final Provisions

BY PLACING AN ORDER, BUYER CONFIRMS THAT BUYER HAS READ, UNDERSTANDS, AND AGREES TO THIS RETURNS, REFUNDS, SHIPPING & COMPLIANCE POLICY IN FULL. Buyer accepts the RUO restrictions, the 180-day return window, the allocation of shipping risk when Route is not purchased, and the chargeback/fraud remedies outlined herein.
